Pre-contractual Information Disclosure Obligation
What does an architect's pre-contractual information disclosure obligation entail?
Active Information Disclosure Obligation
Before a contract can be concluded, the architect must provide the client with certain information (= active information disclosure obligation):
- the company registration number;
- the registered office;
- the professional organisation with which the architect is registered;
- the insurance policy number;
- the details of the insurance company;
- the main characteristics of the business activity (including the description of services to be provided, the method of execution, etc.);
- the fee or the means by which the fee is calculated.
Passive Information Disclosure Obligation
The architect is also required to provide additional information on request (= passive information disclosure obligation), such as:
- a reference to the applicable professional regulations and how they can be accessed;
- information about multidisciplinary activities and partnerships.
This information must be clear, unambiguous and provided in good time, i.e. before the conclusion of the agreement.
