Verification of Construction Partners' Insurance
How can you verify whether the construction partners involved at your construction site are insured?
How to verify?
Insurance is verified by means of:
- The insurance certificates that each construction partner (contractors and other service providers) is required to have in their possession on the construction site.
- The insurance details that must be specified in contractual documents (name and insurer's business registration number and insurance contract number).
Before the works commence, the construction partners must provide the client and architect with a certificate of their 10-year civil liability insurance. This must be overseen by the architect. Note: this oversight obligation relates only to the production of an insurance certificate, not the examination of its content.
What if?
If the construction partner does not voluntarily produce the insurance certificate, the architect must demand in writing that it be produced. If the construction partner still fails to provide the insurance certificate, the architect will instruct the client to take action and, if necessary, stop work on the construction site.
Should the construction partner remain in default, and the work proceed regardless, the architect is best advised to report this to the Federal Public Service for Employment, Labour and Social Consultation.
